Fiscal court repeals firearms control ordinance

Harlan County Attorney Fred Busroe told members of the Harlan County Fiscal Court in a recent meeting the Kentucky Legislature, in their last session, asked counties to formally repeal any local firearms control ordinances per KRS 65.870. He said the legislature said local county government can’t regulate firearms.

In KRS 65.870 it states, “No existing or future city, county, urban-county government, charter county, consolidated local government, unified local government, special district, local or regional public or quasi-public agency, board, commission, department, public corporation, or any person acting under the authority of any of these organizations may occupy any part of the field of regulation of the manufacture, sale, purchase, taxation, transfer, ownership, possession, carrying storage, or transportation of firearms, ammunition, components of firearms, components of ammunition, firearms accessories or combination thereof.”

“I researched and I could not find any ordinances active that actually regulate firearms,” said Busroe. “I’ve prosecuted for 14 years and have never prosecuted anyone for violating such an ordinance. I checked with the sheriff’s office and they’re not aware of any. So, I don’t think we have anything, but we may as well go ahead and have a motion in case there is something obscurely hidden and we’ve got it in our minutes we made a good faith effort to repeal any ordinance regulating firearms within the county’s jurisdiction.”

Busroe said the significance of this action is the county loses their “qualified immunity or ammunity if they allow such a law to be enacted and then people arrested under it or cited under it and prosecuted under it the county will be civilly liable for the damages as well as attorney fees and such.” A motion was made and approval was granted for this action.

A lease agreement between the county and the Kentucky Division of Forestry was also approved during the meeting.

“I really didn’t intend for the restoration of a fire tower to be included in this agreement,” said Grieshop. “I think viewing it as it is may be all that needs to be done. I don’t know how you feel, but I don’t feel particularly comfortable with people climbing up in a fire tower that was designed for employees at that time to be up in. There are just too many risks allowing public access. It can be quartered off with the public just viewing it as something used in time past. It’s a four feet by four feet box up in the air about 60 feet or more and it moves.This lease is a great partnership with the Division of Forestry and will help connect the state park and tie into Letcher County.”

Magistrate Jim Roddy questioned funds being spent on this project. Grieshop told him “money is being spent.”

“Right now we’ve spent money on saving some trees — approximately 200,” said Grieshop. “It takes $7 to save a tree and $300 to haul one out.”

The approval of this lease agreement will allow use of areas within the Kentenia State Forest for construction of a recreational trail and the restoration of Goss Park. The restoration of a fire tower was excluded from the agreement.

Tabled during the meeting was a proposed agreement with the Kentucky Transportation Cabinet. It was to supply 10 pieces of used guardrail for Harlan County roads. It was tabled until officials are contacted about new charges included.

“When the agreement came it was with a charge,” said Grieshop. “They are reconditioning guardrail now. They straighten and re-coat the guardrail and it goes back out. It has changed the playing field from five or six years ago. That’s what we’re facing.”

Another sublease agreement was approved between the county and Sharing with Appalachian People (SWAP). The agreement is for forestry land which is leased to the county and subleased to SWAP.

“SWAP does work on your neighbors’ homes throughout the county and they have been up there for a good number of years and have served our community with their rehabilitation program. This is asking for a renewal. They re not asking for any money. We have not put any money into this. They do all the upkeep on the property and pay all the electricity bills.”

1 Day 30 State Concealed Weapon Permit

This course is held on Tuesdays (following Friday-Monday courses) and some Fridays (following Monday-Thursday courses). (Check course schedule!) This course is available to weekend and midweek students who have completed the 2-Day or 4-Day Defensive Handgun course immediately preceeding the CCW course. In other words, you must attend the very next CCW course offered. Depending on your course schedule, there may be several days of “down time” before your CCW course. The only courses which qualify as a prerequisite for this CCW course are the 2-Day Defensive Handgun and 4-Day Defensive Handgun. You MUST attend all the classroom lectures in the 2-Day or 4-Day Defensive Handgun course as those lectures are prerequisites to the CCW curriculum. You must attend the lectures even if you have heard them before. Other handgun courses such as Skill Builder and Advanced Tactical Handgun DO NOT SATISFY the prerequisite for this CCW course.

Cost: $500.00

Prerequisite Class(s): 2-Day or 4-Day Defensive Handgun taken immediately before this Concealed Weapons Course. No other courses satisfy the prerequisite.

Voters in four states on Tuesday will decide whether they want to enshrine a "right to hunt and fish" in their state constitutions. Idaho, Kentucky, Nebraska and Wyoming all have ballot measures at the polls on Election Day asking if voters want to add constitutional language to protect residents' rights to bag deer, ducks, bass and other game, and prevent attempts to restrict those rights.

Alaska, Arizona, Arkansas, Florida, Kansas, Kentucky, Louisiana, Michigan, Missouri, North Carolina, Ohio, Oklahoma, Texas, Tennessee, Virginia, West Virginia, and Wyoming.

Residents of reciprocal states who hold permits issued by their states of residence may carry concealed firearms in South Carolina, but must abide by the restrictions in the South Carolina CWP law. For that reason, out of state residents of reciprocal states should familiarize themselves with restricted carry locations and other provisions of South Carolina law posted on this website. South Carolina permittees who carry firearms in reciprocal states are likewise responsible for familiarizing themselves with the applicable laws and regulations of the reciprocal state. Reciprocity with Other States

Attorney General Stenehjem recognizes the importance of concealed weapon (concealed carry) reciprocity to North Dakota residents and visitors to our great state; he is committed to maintaining reciprocity with as many states as possible.

Reciprocity is a two-way agreement, requiring both states to recognize each other’s licenses. Reciprocity with North Dakota is at the discretion of the other state. Generally, a state will agree to reciprocity only if ND’s laws are “substantially similar” to that state’s laws. Reciprocity may be conditional; for example, if the other state has a residency requirement, that state may recognize ND licenses held by ND residents but not those held by non-residents.

It is up to the license holder to review the laws of both the issuing state and reciprocal state to ensure full compliance.

Updates are made only when there is a change to North Dakota’s license reciprocity with other states. Regardless of the date of the last update, the following information is current.

North Dakota recognizes concealed weapon licenses from any state which recognizes the ND license. The following tables show how each state treats the North Dakota license. The “key” to explain the letters after each state is at the end of the page, below the table.

Recognition of Concealed Handgun Permits

Permits Issued By Other States Which Are Recognized By Nebraska

On August 30, 2009, Nebraska began recognizing CCW permits issued by those states which the

Nebraska Attorney General has determined have standards equal to or greater than Nebraska.

This recognition extends ONLY to persons who are NOT residents of Nebraska.  This change in

the law allows non-resident permit holders from the approved states to carry handguns

concealed in Nebraska the same as if they held a Nebraska permit.  See our regulations on this

web site for restrictions on places that a concealed weapon can be carried.

Approved states

The following states have standards equal to or greater than the standards

contained in Nebraska’s statute:

Alaska, Arizona, Arkansas, Colorado, Connecticut, Florida, Hawaii, Idaho,

Kansas, Kentucky, Louisiana, Michigan, Minnesota, Missouri, Nevada, New

Jersey, New Mexico, North Carolina, North Dakota (class one permit), Ohio,

Oklahoma, Oregon, Rhode Island, South Carolina, Tennessee, Utah, Virginia,

West Virginia, Wyoming and the District of Columbia.

The following states have standards equal to or greater than the standards

contained in Nebraska’s statute but only to the extent the permit holder in that

state is twenty-one (21) years of age or older:

California, Iowa, Maine, Montana, North Dakota (class 2 permit) and Texas.

The state of Vermont does allow the carrying of concealed firearms within its

borders, but it does not require a permit to do so.  As a result there is no permit

to recognize.

Unapproved states

The following states will not be recognized at this time because the Attorney

General has determined that they do not have standards that are equal to or

greater than the standards contained in Nebraska’s statute:

Alabama, Delaware, Georgia, Indiana, Maryland, Massachusetts, Mississippi,

New Hampshire, New York, Pennsylvania, South Dakota and Washington.

Mississippi Firearms Permits Reciprocity

With what other states does Mississippi have reciprocity? (Whose permits do we honor, who honors ours?)

Mississippi recognizes valid, unrevoked and unexpired license to carry stun guns, concealed pistols, or revolvers issued in other states.  Also, the Department of Public Safety is authorized to enter into reciprocal agreements with other states if those states require a written agreement for reciprocity.  Mississippi has written reciprocity agreements with the following states:  Alabama, Alaska, Arizona, Arkansas, Colorado, Florida, Georgia, Indiana, Kentucky, Louisiana, Michigan, Minnesota, Missouri, Montana, North Carolina, New Hampshire, Oklahoma, Pennsylvania, South Dakota, Tennessee, Texas, Utah, Washington, Virginia, West Virginia, Wyoming.

RECIPROCITY

Pursuant to R.S. 40:1379.3(T)(1) a valid permit in another state is valid in Louisiana if the issuing state honors concealed handgun permits issued by Louisiana.

Permit holders are reminded that while carrying a concealed handgun in another state they are bound by that state’s laws governing concealed carry and permittees from other reciprocal states are bound by Louisiana concealed carry laws while in Louisiana.

CCDW Reciprocity

Effective, July 15, 1998, Kentucky recognizes valid carry concealed weapons licenses issued by other states and, subject to the provisions of Kentucky law, a person holding a valid license from another state may carry a concealed deadly weapon in Kentucky.

Written inquiries regarding recognition of Kentucky carry concealed licenses have been made to all states and U.S. territories.  The map and chart below detail those responses.

Certain other jurisdictions that recognize Kentucky carry concealed permits may limit the right to carry concealed to handguns only and not allow for the carrying concealed of other types of weapons. You are advised to contact all other jurisdictions in which you intend to carry concealed weapons with questions regarding these issues.

Section 16-11-129 is not forbidden from transporting a loaded firearm in any private passenger motor vehicle.

RECIPROCITY AGREEMENTS FOR GUN PERMITS

You asked if Connecticut has any agreement with other states that would allow (1) people from those states to carry handguns in Connecticut without a Connecticut permit and (2) Connecticut residents to carry guns in member states with a Connecticut permit.

Connecticut does not have any gun reciprocity agreements that would allow nonresidents to carry handguns in Connecticut under a permit issued by another state.

With certain minor exceptions (not pertinent here), anyone carrying a handgun in Connecticut must have a state gun permit. Also, people may transport unloaded handguns through Connecticut for lawful purposes without a Connecticut permit if they (1) are not otherwise prohibited from shipping, transporting, receiving, or possessing guns and (2) are transporting them from one state where they can legally possess and carry guns to another state where they can legally possess and carry them. They cannot use, carry, sell, deliver, or otherwise transfer the guns while in the state. Also, they must keep the guns (and any ammunition) in an area where they are not directly or readily accessible from the passenger compartment of a vehicle. If the vehicle does not have a compartment separate from the passenger compartment, they must lock the guns (and any ammunition) in a container other than the glove compartment or console (CGS § 29-38d).

The following states currently honor gun permits from all other states, including Connecticut, thereby allowing gun permit holders from another state to carry handguns in the state subject to the same standards that apply to resident permit holders: Alaska, Arizona, Idaho, Indiana, Kentucky, Michigan, Missouri, Oklahoma, South Dakota, Tennessee, and Utah.

Texas has reciprocity agreements with several states, not including Connecticut. It has issued a unilateral proclamation honoring Connecticut permits (http://www.txdps.state.tx.us/administration/ crime_records/chl/reciprocity.htm).

Montana’s attorney general has determined that under Montana law, the holder of a Connecticut gun permit may legally carry handguns under Montana law (http://www.doj.mt.gov/enforcement/

criminaljustice/concealedweapons.asp).

Vermont does not issue handgun permits. People from any state including Connecticut, may carry handguns in the state without a permit.

Reciprocity

Updates are made only when there is a change to Colorado’s permit reciprocity with other states. Regardless of the date of the last update, this information is current.

Pursuant to Colorado law (CRS 18-12-213), the State of Colorado will recognize a valid permit issued in another state IF the permit was issued to a resident of the state issuing the permit, and the permit tee is 21 yrs of age or older, AND the other state recognizes Colorado permits as valid in their state. Hence, a “yes” in the following table also indicates that a valid Colorado permit is recognized in that state, subject to their laws. When traveling with a Colorado permit, it is advisable to contact the state you are visiting to confirm reciprocity and to review that state’s firearms laws.

 

The state of Colorado no longer recognizes the validity of any permit issued by any state to a nonresident of that state (see C.R.S 18-12-213 amended 2007), specifically they must be a resident of the state that issued the concealed handgun permit and must be in possession of a valid drivers license or identification card issued by that same state.
